Live Local Act

On March 29, 2023, Governor Ron DeSantis enacted Senate Bill 102, which is now designated as Chapter 2023-17 and will take effect on July 1, 2023. This legislation, referred to as the "Live Local Act," establishes specific zoning and land use preemptions for developments that allocate a minimum of 40% of their units for workforce housing. The exemptions provided by the "Live Local Act" encompass preemptions related to certain development regulations, including density and height restrictions, and mandate administrative approval for qualifying projects. Additionally, the act obligates the city to maintain a comprehensive list of all real estate owned by the city or the Community Redevelopment Agency (CRA) that is suitable for affordable housing initiatives. Developers intending to undertake projects in accordance with the Live Local Act must adhere to the subsequent procedure:

• The Developer/Owner is required to arrange a Live Local pre-application meeting with the Planning & Zoning Staff.

• Following the approval of this meeting, the applicant must submit a comprehensive application package for the Development Application Review Team (DART) to obtain the necessary approval.

• The Planning & Zoning Administrator or their designated representative will then present the application to the City Commission for final evaluation and approval during public hearings.

• The Contractor is responsible for completing the permit applications and selecting the Live Local tab, which will notify the Development Services Director and Development Services Supervisor to allocate the Live Local project to a team member, thereby facilitating and expediting the reviews conducted by Building, Planning & Zoning, Fire, Engineering, and Utilities departments.

The City of Boynton Beach will prioritize the processing of Live Local development applications, site plans, land use changes, rezoning requests, plat approvals, building permit applications, and inspections in alignment with the provisions of this Live Local Act Review policy.
